Hypothetical Example of Unpaid "Stay-Over" Claims

Suppose a full time, $15.00 per hour Security Guard spent an average of 1.5 hours per week of unpaid "stay-over" - over a three-year period. Suppose further a court found willful violations and applied liquidated (double) damages for the wage violations under the Fair Labor Standards Act.

Such unpaid claims could be calculated as follows:

$15.00 x 1.5 hours per week x 150 weeks x 1.5 (overtime rate) x 2 (liquidated damages) = $10,125.00
